The property will be leased to the Customer, who declares that a number of people not exceeding that established at the time of reservation will stay in the property, including him/herself, for the period and at the rental established at the time of reservation.
To block his/her reservation, the Customer will be required to pay a deposit al 30%, pursuant to Article 1385 Italian Civil Code.
The payment of the balance must be made 16 days before departure. The deposit already paid will be credited to the fee due.
In the event of failure to pay within the 16th day before arrival, the booking may be cancelled, and the deposit will be withheld and will not be refounded.
The property will be delivered to the Customer by 2pm on the day of his/her arrival and will be returned by 10am on the last day of the lease, except as otherwise notified by ourselves. All costs for the supply of electricity and water, service charges, maintenance charges, including minor maintenance charges, will be borne by the Owner, except as otherwise notified by ourselves.
For strategic commercial reason, the original name of chosen property (only the name) may change).
The Customer shall report to the Agency any defects in the property and its furnishings within 24 hours of collecting the keys to the property. Failing such report, the said defects and differences will be deemed attributable to the Tenant.
The property is leased solely for tourist purposes within the meaning of Article 1(2) c), Law No. 431/98. - The Customer may collect the keys to the property only after paying all sums due.
The customer undertakes to comply with the rules of the building.
The customer undertakes to comply with any of the house rules.
Should a number of people exceeding that established by the parties, stay overnight or use the apartment and condominium services (swimming pool, beach, etc., if any), the Customer shall pay the amount of rent established as penalty (Article 1382 Italian Civil Code) to the Agency, which will collect it on behalf of the Owner.
Further people may stay in the property during the lease only upon prior notice to the Agency and subsequent approval by the Owner. An 'x pax per night' price will be charged for each extra guest.
The property cannot be sublet.
Should the Owner demand payment of a non-interest bearing pecuniary deposit, this sum will be paid by the Customer upon delivery of the keys to the property and will be returned thereto at the end of the lease, after checking the status of the property and of its furnishings.
At the time of return of the Customer's deposit, if any, the amount necessary to repair any damages to the property and/or its furnishings, where these are attributable to the Customer, will be deducted therefrom. If such damages exceed the deposit, this difference will be paid to the Owner.
Should the keys to the property be returned before expiry of the lease, the rental already paid will not be returned.
In the event of cancellation up to 30 days before the date of arrival, 20% of the total amount will be withheld. In the event of cancellation as from the 29th to the 16th day prior to the date of arrival, the deposit (30% of the total amount) will be retained and will not be refunded. In the event of cancellation as from the 15th to the 8th day prior to the date of arrival, 50% of the total amount will be retained and will not be refunded. In the event of cancellation as from the 7th day prior to the date of arrival, the total amount will be withheld and will not be refounded.
The Customer who cancels his/her reservation may be replaced by a third party, giving notice thereof and reporting all data of the transferee in writing, at least 7 days before the expected date of arrival. The Customer who cancels his/her reservation is jointly liable with the transferee for payment of the balance. In the event of missed arrival of one or more people staying in the property, no refunds will be made.
In the event of the Customer's missed arrival due to extraordinary events (missed arrival of means of arrival on the isalnd of Pantelleria or serious disease that can be proved), the Customer will be reimbursed with 50% of the total amount of the lease only.
In case of double booking/overbooking and similar events, Travel and Fair T.O. will offer an alternative accomodation, equal in price, in level of quality, and in destination. If Travel and Fair T.O. offeres this alternative, each type of claim or complaint by the Customer shall not be taken into account.
During the lease period, the property may be visited by the Agency or by the Owner and third parties at any time, subject to prior notice to the Customer.
Travelandfair and to the extent permitted by law, neither we nor any of our operators, managers, employees, representatives, subsidiaries, affiliates, (distribution) affiliate partners, licence holders, agents or people involved in the production, sponsorship, promotion or divulgation of the Website and its content, will be liable (i) for any punitive, special, incidental, or consequential loss or damage, any loss of production, profit, income, contract, any damage to a party's good name and reputation, loss of rights, (ii) for the inadequacy of the Facilities (descriptive) information (regarding its rates, availability and rating) published on our Website, (iii) for the services or products offered by Facilities , (iv) for any (direct, indirect, consequential, or punitive) damage, for any loss or cost incurred, paid or experienced, arising from the impossibility to use or from the delay of our Website, though resulting from or connected to its use, or (v) for (personal) damage, death, damage to property or other types of (direct, indirect, special, consequential, or punitive) damage, for any loss or cost incurred, paid or experienced, for (legal) actions, errors, breaches, (gross) misconduct, intentional incorrect administration, omissions, negligence, misrepresentations, civil/objective liability for a tort that is attributable (whether in part or fully) to the Facilities (to its employees, managers, executives, agents, representatives or affiliates), including for (partial) cancellations, overbookings, strikes, force majeure or any other event beyond our control.
